Terms of Service

Welcome to MedCoach. These Terms of Service (“Terms”) are a contract between you and MedCoach (“MedCoach,” “we,” “us,” or “our”), a sole proprietorship operated by Aayush, based in Florida, United States, governing your use of medcoach.io and any related services (collectively, the “Service”).

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old to use MedCoach and capable of entering into a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Your account

You are responsible for maintaining the security of your Google account used to sign in, for all activity on your MedCoach account, and for providing accurate information. Tell us right away if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.

Subscriptions and payments

  • Paid plans are billed in advance on a recurring basis (monthly or annually, depending on the plan you choose).
  • Payments are processed by Stripe. By subscribing, you authorize us to charge the payment method on file for each renewal period until you cancel.
  • You can cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period; you retain access until then.
  • Except where required by law, payments are non-refundable. If you believe you were charged in error, email us within 30 days and we will review in good faith.
  • We may change pricing with at least 30 days' notice. Changes take effect at your next renewal.

Your content

You retain all rights to the content you create, upload, or enter into MedCoach (“Your Content”). You grant us a limited, worldwide, royalty-free license to host, store, transmit, and process Your Content solely to provide and improve the Service for you, including by sending relevant portions to our AI providers to generate outputs on your behalf.

We do not sell Your Content and we do not use it to train public AI models. You are responsible for ensuring you have the right to submit any content you upload (for example, you should not upload documents you do not have permission to share).

AI outputs

MedCoach uses large language models to generate drafts, suggestions, feedback, and other outputs based on Your Content. AI outputs:

  • Are generated automatically and may contain errors, inaccuracies, or omissions.
  • Are a starting point, not a finished product. You are responsible for reviewing, editing, and verifying anything you submit as part of your medical school application.
  • Are not legal, medical, educational, or professional advice.
  • May be similar to outputs produced for other users given similar inputs.

You are solely responsible for how you use AI outputs, including compliance with AMCAS, AACOMAS, TMDSAS, and individual school policies on authenticity and applicant- written content.

Acceptable use

When using MedCoach, you agree not to:

  • Violate any law, regulation, or third-party right.
  • Submit content that is unlawful, harassing, defamatory, or infringing.
  • Attempt to reverse engineer, scrape, or resell the Service, or use it to build a competing product.
  • Share your account, or use automated means to access the Service beyond documented APIs.
  • Upload malware, attempt to probe or disrupt the Service, or interfere with other users' accounts.
  • Submit another person's personal information without their permission.
  • Use outputs in a way that misrepresents authorship to any institution that prohibits it.

Our content and intellectual property

MedCoach, including its software, design, text, logos, and other materials (excluding Your Content and third-party materials), is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non- transferable license to use the Service for its intended purpose during your subscription. All rights not expressly granted are reserved.

Third-party services

The Service relies on third-party providers (including Supabase, Vercel, Google, Anthropic, OpenAI, Stripe, and Resend). Your use of the Service is also subject to their terms where applicable. We are not responsible for third-party services that are outside our control.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms, if required by law, or to protect the Service or other users. On termination, your license to use the Service ends. Sections that by their nature should survive (including ownership, disclaimers, limitations of liability, and dispute resolution) will survive.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non- infringement, and quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, secure, or produce any particular outcome, including admission to any medical school.

Limitation of liability

To the maximum extent permitted by law, MedCoach and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to the Service or these Terms, even if advised of the possibility of such damages.

Our total liability for any claim arising out of or related to the Service or these Terms is limited to the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or USD $100, whichever is greater.

Indemnification

You agree to indemnify and hold MedCoach harmless from any claims, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms or any law or third-party right.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction there. Nothing here prevents either party from seeking injunctive relief in any court of competent jurisdiction.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms.
